1. Acceptance of Terms

These Terms & Conditions ("Terms") govern the use of CourtTrack Analytics (referred to as "CourtTrack," "we," "us," or "our"), operated as an ABN-registered sole trader business based in Victoria, Australia. By submitting game footage, purchasing an analytics pack, activating a team dashboard, or otherwise using our website or service, you ("Client," "you," "your") agree to be bound by these Terms.

If you are registering or paying on behalf of a club, team, or family, you confirm you have the authority to accept these Terms on their behalf.

3. The Service

CourtTrack Analytics processes submitted game footage and produces an Analytics Pack covering playing time, shot data, and season trends, delivered via a team Dashboard. The specific inclusions of each plan (Player, Team, Team+) are set out on our Pricing page and may be updated from time to time.

The Service is provided on a game-by-game or season-pass basis, as agreed at sign-up. We reserve the right to decline to process footage that is unusable (see Section 5) or to decline service to any Client at our discretion, including for non-payment or breach of these Terms.

4. Accounts & Access

Each team is issued unique access credentials for its coach and family Dashboards by CourtTrack. Clients are responsible for keeping these credentials confidential and for all activity that occurs through their access. Access codes are personal to the team they are issued for and must not be shared outside of the club, coaching staff, or rostered families.

We may revoke or reissue access credentials at any time, including where we reasonably suspect misuse.

5. Footage & Client Responsibilities

The Client is responsible for filming and submitting game footage in accordance with the process set out on the footage submission page. By submitting footage, the Client grants CourtTrack a licence to view, process, and analyse that footage solely for the purpose of producing the Analytics Pack.

Footage Standards

Footage must reasonably show the court, players, and scoreboard/clock where possible. We will process footage in good faith on a best-efforts basis. If footage is assessed as unusable (for example, the court or players are not visible, the file is corrupted, or the recording does not cover the full game), we will notify the Client and will not charge for that game.

Duplicate Submissions

Our system flags footage submissions that appear to duplicate an existing submission for the same team, date, and opposition. Duplicate submissions will not be processed or charged twice without the Client's confirmation.

6. Fees & Payment

Current pricing is published on our Pricing page and applies at the time of purchase. Prices are in Australian dollars and, unless stated otherwise, exclusive of any applicable taxes.

Payment is arranged directly with CourtTrack (for example, by bank transfer or the payment method confirmed at sign-up). Analytics Packs will not be released via Dashboard until payment for the relevant game or season pass has been confirmed, except where a free trial applies.

We reserve the right to change our pricing for future games or season passes at any time, with reasonable notice. Price changes will not affect games already paid for.

7. Cancellation & Refund Policy

In short: you can cancel any time before we've started processing a game. Once a game has been processed and the Analytics Pack delivered, it's non-refundable. Season passes are refunded on a pro-rata basis for games not yet processed.

Cancellation requests must be made in writing to [email protected], quoting the team name and, if applicable, the specific game(s). We will confirm receipt and the applicable outcome under this policy within 3 business days.

Our Right to Cancel

We may cancel or decline to process a game or season pass at our discretion — for example, if footage cannot reasonably be processed, if fees remain unpaid, or if these Terms are breached. Where we cancel a game we have not yet processed, the Client will not be charged (or will be refunded if already paid).

Australian Consumer Law

Nothing in this policy limits any rights or remedies you have under the Australian Consumer Law that cannot lawfully be excluded, including where the Service is not provided with due care and skill.

8. Free Trial

New teams may access one free game analysis with no payment required, as described on our Free Trial page. The free trial is limited to one game per team and may be withdrawn or amended at our discretion. No cancellation or refund is applicable to trial submissions, as no fee is charged.

9. Delivery & Turnaround

We aim to deliver each Analytics Pack within the timeframe confirmed to the Client at sign-up. Turnaround times are estimates and may vary based on game volume and scheduling, and are not a guaranteed deadline unless separately agreed in writing.

10. Data Accuracy

Analytics Packs are produced from a review of the submitted game footage and are provided as an analytical aid to support coaching and player development decisions. While we take care in producing each Analytics Pack, statistics are derived from footage review and are provided "as is," without warranty that every data point is free of error. Analytics Packs are not an official scoring record and should not be treated as a substitute for the official competition scoresheet.

If a Client identifies a material error in an Analytics Pack, we will review and, where appropriate, correct and reissue it at no additional cost.

11. Intellectual Property

The Client retains ownership of the Footage they submit. CourtTrack retains ownership of the Analytics Pack, Dashboard, underlying software, methodology, and all associated intellectual property. Clients are granted a licence to access and use their team's Analytics Packs for personal, coaching, and player development purposes — not for commercial redistribution or resale.

12. Privacy & Minors' Data

Analytics Packs contain performance data relating to junior athletes, most of whom are minors. By submitting a team's footage and roster, the Client (club or nominated team contact) confirms that appropriate consent has been obtained from players and/or their parents or guardians for game footage to be reviewed and performance data to be produced and shared with the coach and rostered families, in line with the club's own participation and media consent arrangements.

The Client must retain evidence of that consent (for example, as part of the club's own registration or media consent process) for as long as the team is engaged with the Service, and must provide it to CourtTrack on request. CourtTrack may decline or pause processing of a team's footage if requested evidence of consent is not provided within a reasonable time.

We take reasonable steps to restrict Dashboard access to the coach and families associated with each team. For details on how we collect, store, and use personal information, see our Privacy Policy.

13. Liability

To the maximum extent permitted by law, CourtTrack's total liability arising out of or in connection with the Service is limited to the amount paid by the Client for the specific game or season pass giving rise to the claim. We are not liable for indirect or consequential loss, including loss arising from reliance on Analytics Pack data for team selection, recruitment, or similar decisions.

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law that cannot lawfully be excluded.

14. Termination

Either party may end the arrangement for future games at any time in accordance with Section 7. We may suspend or terminate access to the Service immediately if these Terms are breached, including non-payment or misuse of Dashboard access.

15. Service Availability

CourtTrack relies on external website hosting, database, and email providers to run the Service, and while we work to keep everything running smoothly, we can't promise the Service will always be available or completely fault-free. We won't be responsible for delays or interruptions caused by planned maintenance, an outage at one of our providers, or anything genuinely outside our control — for example, severe weather, a major internet or power disruption, or a new legal restriction affecting how we operate. If something like this pushes out a game's turnaround time, we'll let the affected Client know as soon as we reasonably can.

16. Dispute Resolution

If something goes wrong between us, we'd rather sort it out directly than end up in a formal dispute. Please email us at [email protected] explaining the issue, and we'll aim to respond and work through it with you within 10 business days. If we can't reach an agreement that way, either of us can suggest bringing in an independent mediator before taking things further. None of this stops either party from going to court for urgent relief where that's genuinely needed, and it doesn't affect any rights you have under the Australian Consumer Law that can't be excluded.

17. General

These Terms are governed by the laws of Victoria, Australia. We may update these Terms from time to time; the version published on this page applies to games and season passes purchased after the update takes effect. Continued use of the Service after an update constitutes acceptance of the revised Terms.

The parties each submit to the non-exclusive jurisdiction of the Victorian courts for anything that ends up needing to go that far.
